Terms & Conditions

Thank you for volunteering with Golden Eagle Audubon Society (“GEAS”). To get started, we need you to complete and sign this Agreement, Waiver, Release & Acknowledgement of Risk (“Release”). If Volunteer is under the age of 18, this Release must be signed by Volunteer’s legal guardian. The undersigned Volunteer (as may be referred to as “I”, “me” or “my”) or legal guardian as applicable, expressly acknowledges and agrees as follows:

Volunteer Not an Employee: I am donating my time and services as a volunteer to GEAS without any compensation and will at no time be considered an employee or independent contractor of GEAS.

Policies and Safety Rules: I agree to comply with GEAS volunteer policies, safety rules, and conduct expectations. I understand that GEAS values inclusion and does not tolerate bullying, harassment, threatening behavior, or violence of any kind. I understand that noncompliance may result in termination of my volunteer status at GEAS’ sole judgment.
Awareness and Assumption of Risk: I acknowledge that volunteering for GEAS has risks, which may arise in a variety of ways either through my actions or those created by other volunteers and/or participants. They include without limitation: contact with allergenic plants and/or stinging insects, exposure to outdoor elements, tool use, transportation risks, being in the presence of others, and improperly administered or unavailable medical aid. GEAS and all other involved organizations and their respective agents, volunteers and affiliates, hereby explicitly make no representations or warranties whatsoever as to whether volunteer locations are safe or whether any safety recommendations provided are comprehensive or adequate. I am voluntarily participating with the knowledge of these risks, and expressly assume all risks of injury, harm, or financial obligation arising from or in any way related to volunteering for GEAS.

Release from Liability: In consideration for being allowed to participate in GEAS events and activities I, binding my heirs, next of kin, executors, administrators, and assigns, do hereby fully and forever release, discharge and hold harmless GEAS, its officers, directors, employees, agents, insurers and representatives, successors and assigns from any and all liability, claims, causes of actions, damages, losses, and demands of any kind, either in law or in equity and whether known or unknown, arising from or in any way related to participation in the volunteer activities wherever, whenever, or however the same may occur. I understand and acknowledge I am discharging GEAS from any liability or claim that I may have against GEAS.
Medical Conditions and Care Consent and Waiver: I understand I am solely responsible for knowing my own physical condition and needs and making my own decisions about my volunteer work. I will disclose all current conditions and allergies to the project lead of the volunteer efforts I’m involved with. I authorize GEAS to provide me with first aid and to arrange medical assistance, transportation, and emergency medical services for me if I get hurt while volunteering. I understand GEAS is not obligated to provide this care. I also understand I am solely responsible for any costs related to my medical treatment and transport. I understand GEAS has not arranged and does not carry any insurance of any kind for my benefit.

Use by GEAS of My Name, Image, Voice, and Creations: I understand GEAS may take photos or videos of me. I consent to use of these images, voice recordings, my name and story in any format by GEAS. I grant full rights to GEAS of any documents, website content, photos, images, videos, or other materials or works I may create in the course of volunteer activities, and any intellectual property rights in or derivatives of such materials. If you do not wish to have your photo publicized by GEAS, please notify us at info@goldeneagleaudubon.org.

General Provisions: This Release is intended to be as broad and inclusive as permitted by the laws of the State of Idaho and shall be governed by and interpreted in accordance with the laws of the State of Idaho. If any provision of this Release is held illegal or unenforceable in a judicial proceeding, such provision will be severed and the remainder of the Release shall remain operative and binding. I understand this Release will be binding for so long as I am a volunteer with GEAS and it is my responsibility to update any of my information related to this Release. This Release will run in favor of, and may be enforced by GEAS and will bind my heirs, next of kin, and legal representatives.

Driving Policy: I pledge that if I drive my own vehicle on behalf of GEAS, I will maintain adequate personal auto liability insurance. I also understand that as a volunteer driver, my personal auto insurance will be activated for any accidents or incidents that involve my vehicle while I am serving as a volunteer driver for GEAS.

I affirm I am of legal age and acknowledge and agree I have read and understood this Release and that I voluntarily, freely, and without duress expressly agree to be bound by all terms in their entirety, including any waiver of legal rights and remedies.
